Consumer forum orders Flipkart and Adi Laxmi e-Comm to deliver a new Oppo Reno 2F phone to the customer

A 37-year-old tuition teacher bought himself a birthday gift online but what was delivered was a damaged mobile phone and of a totally different company. The Ahmedabad City Consumer Dispute Redressal Commission in a recent order directed the e-commerce company to either replace the phone or refund the entire amount. Danilimda resident Shakir Malek ordered an Oppo Reno 2F on Flipkart in September 2020 and paid Rs 17,990. When the product was delivered, Malik was taken aback. There was a Nokia phone in a damaged condition inside the box instead of an Oppo phone.
“The charger, box and other items were from Oppo but the handset was a damaged Nokia. I contacted the Flipkart customer care multiple times and also sent emails but the company did not give me a proper answer,” Malek said. He then filed a complaint at the Ahmedabad city (main) consumer forum against Flipkart and the product’s seller firm called Adi Laxmi e-Comm Private Limited.
On receiving a notice, Flipkart in a written submission argued that the company is just a platform where companies sell their products, and the platform is not responsible for product insurance, warranty, delivery, cost, discount, after-sales service or returns. It said it is a marketplace where every company advertises and sells its products. The seller firm, for its part, argued that it is a registered seller on Flipkart and the mobile phone was acquired from the manufacturer and sent in a packed condition. It said there was no evidence that the buyer concerned had filed any complaint to support his claim.
After hearing all the parties concerned, the commission observed that Flipkart’s argument of being just a platform and they don’t have a responsibility is not maintainable as they have to ensure that companies selling goods through it do not have any deficiency in service. And the seller had sent some other phone than the one bought which amounts to deficiency in service.
Delivering its judgment, the commission ordered Flipkart and Adi Laxmi e-Comm to deliver a new Oppo Reno 2F phone to the customer and take back the delivered Nokia phone, and if that was not possible then Rs 17,990 paid by Malek should be refunded with 7% interest from the date of filing the complaint. …….
